SCADA Alarm Notification Program — Effective September 28, 2026
Program Description
The Brothers Petroleum SCADA Alarm Notification Program (the "Program") is an internal, non-marketing operational messaging service operated by Brothers Petroleum, LLC ("Brothers Petroleum," "we," "us," or "our"). The Program sends automated SMS text messages and/or voice notifications generated by our CygNet SCADA system to enrolled field operators, supervisors, on-call personnel, and authorized contractors ("Recipients") regarding the status of field equipment and facilities, including alarms, shutdowns, communication failures, high/low pressure, level, flow, and other device-status conditions. The Program is not available to the general public. No promotional, marketing, or sales messages are sent through the Program.
Enrollment and Consent
Recipients are enrolled only after providing express consent to receive alarm notifications at a mobile number they designate. Consent is collected by Brothers Petroleum management through a written or electronic enrollment form, or through the Recipient's supervisor as part of the on-call or alarm call-out assignment process. By providing your mobile number and consenting to enrollment, you agree to receive automated, recurring operational text messages from Brothers Petroleum at that number. Consent to receive Program messages is not a condition of purchasing any goods or services. The enrollment form is available at brotherspetroleum.com/optin.
Message Frequency
Message frequency varies and depends on field conditions, equipment status, and the Recipient's alarm assignments and on-call schedule. Recipients may receive multiple messages per day during active alarm conditions and may receive messages at any time of day or night.
Message and Data Rates
Message and data rates may apply according to your mobile carrier plan. Brothers Petroleum is not responsible for charges incurred from your wireless carrier.
Opting Out
You may opt out at any time by replying STOP to any Program message. You will receive one final confirmation message, after which no further messages will be sent to that number. You may also opt out by notifying your supervisor or the contact listed below. To re-enroll, reply START or contact your supervisor. Because Program messages support field safety and equipment monitoring, Recipients who hold an on-call or alarm response assignment should notify their supervisor before opting out so alternative notification arrangements can be made.
Help
For help, reply HELP to any Program message, or contact us at: Brothers Petroleum, LLC · P.O. Box 1488 · Cypress, TX 77410 · Email: AP@brotherspetroleum.com · Phone: 281-356-7767
Supported Carriers and Delivery
The Program is supported by major U.S. wireless carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on network availability, device status, coverage, and other factors outside our control.
Not a Sole Safety System
Program notifications are a supplemental convenience tool. Delivery of any message is not guaranteed, and the Program must not be relied upon as the sole means of detecting, reporting, or responding to emergencies, equipment failures, or unsafe conditions. Recipients must continue to follow all Brothers Petroleum operating procedures, site-inspection requirements, emergency response plans, and applicable regulations. In an emergency, call 911.
Limitation of Liability
To the fullest extent permitted by law, Brothers Petroleum shall not be liable for any delayed, failed, incomplete, or inaccurate message, or for any damages arising from the use of or inability to use the Program.
Changes
We may modify these Terms or discontinue the Program at any time. Material changes will be communicated to Recipients through the Program or through normal company communication channels.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
